Welcome to Nilpar Gallery. These Terms of Service ("Terms") govern your use of the website nilpargallery.com and the purchase of any products (Original Artworks or Limited Edition Prints) from Nilpar Gallery.

By accessing this website or purchasing artwork, you agree to be bound by these Terms. If you do not agree with any part of these terms, please do not use our website.

1. Intellectual Property & Copyright

The most important rule of art collecting: Purchasing an artwork does not transfer the copyright to the buyer.

• Ownership: All content on this website, including images of artwork, text, logos, graphics, and the artworks themselves, is the exclusive intellectual property of Niloofar K. Afshar and Nilpar Gallery.

• Restrictions: You may not reproduce, distribute, modify, create derivative works from, or exploit any of the content or actual artworks for commercial purposes (e.g., you cannot buy a painting and then print it on t-shirts to sell).

• Personal Use: You are granted a limited license to access and view the website solely for personal use.

2. Accuracy of Artwork Representation

We specialise in gold leaf and textured mixed-media art. These materials interact with light in ways that are difficult to capture digitally.

• Colour & Texture: We have made every effort to display the colours, textures, and metallic sheen of our products as accurately as possible. However, we cannot guarantee that your computer monitor's display of any colour will be accurate.

• Handmade Nature: Unlike mass-produced items, our prints and originals may exhibit slight variations inherent in the hand-gilding and printing processes. These are not defects but markers of authenticity.

3. Terms of Sale

• Pricing: All prices are listed in Australian Dollars (AUD) and include GST where applicable. Prices for our products are subject to change without notice.

• Order Acceptance: We reserve the right to refuse any order you place with us. In the event that two customers purchase the same unique Original Artwork online simultaneously, the first processed order will be honoured, and the second will be fully refunded.

• Payment: Full payment is required before any artwork is shipped or collected.

4. Shipping, Returns & Collection

Your purchase is also subject to our Shipping & Returns Policy, which covers:

• No "change of mind" refunds.

• Procedures for damaged goods.

5. Certificate of Authenticity

All Original Artworks and Limited Edition Prints sold by Nilpar Gallery are accompanied by a signed Certificate of Authenticity (CoA). This document is vital for the provenance and future valuation of the work. It is the collector's responsibility to safeguard this document, as lost CoAs cannot constantly be reissued.

6. Limitation of Liability

Nilpar Gallery shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our website or products. We do not warrant that the website will be uninterrupted or error-free.

7. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
